How Much is the Average Personal Injury Settlement in Illinois

Personal injury cases are as unique as the individuals injured. Some accident victims will suffer temporary sprains or strains, while others can face permanent paralysis with a major neck injury. Many people wonder what the average personal injury settlement is for Illinois accidents. At Tuite Law, we have handled hundreds of cases, so we have a good idea of the amount of compensation our clients might receive. Although there are few studies specific to Illinois, we have found different sources of information regarding settlements for various accidents. Contact us if you have questions about the injury claims process.

The Amount Depends on the Case

Tuite Law helps people injured in all sorts of accidents. Here are some settlement averages based on the type of accident:

  • Dog bites. According to the Insurance Information Institute, the average dog bite settlement in Illinois for 2024 was $64,941.
  • Car accidents. Between 2015 and 2020, the average settlement for personal injuries in car accidents nationwide was $29,700. For Illinois specifically, the numbers are similar, with one study finding the average settlement to be around $27,000.
  • Truck accidents. Truck accidents tend to cause more damage than car wrecks, so it is not surprising that the average settlement is generally higher. One study found that the average truck accident settlement nationwide was over $400,000.
  • Workplace accidents. According to the National Safety Council, the typical workplace accident was worth $44,179 in 2021-2022. A work-related motor vehicle collision, however, was worth much more, at $90,914. These numbers are not specific to Illinois but apply nationwide.

How Much is Your Case Worth?

The average does not tell us much about how much a specific client can receive for an injury claim. Some will receive much more than the average, while some people will receive less. In Illinois, various factors influence the amount of a settlement:

  • Economic damages. These are financial losses suffered as a direct result of the accident. Some damages include medical bills and lost income. Damage to your car is also a type of economic loss.
  • Non-economic losses. Injured victims can receive compensation for pain and suffering, disfigurement, mental anguish, and depression. Typically, the more severe an injury, the more pain and suffering damages a person receives.
  • Contributory negligence. If a victim contributed to their accident, their compensation will be reduced by their degree of fault. As an example, imagine you are 40% to blame for a car crash. Your settlement will be 40% less than if you were not at fault.
  • Defendant’s resources. Our clients can only receive a settlement if the defendant can pay. A defendant who has no insurance or any other resources might be “judgment-proof.”
